Abstract
Achieving equality among unequals in international environmental law presents a complex challenge due to the diverse nature of states in terms of economic development, political power, and environmental impact. This research explores the concept of equality in the context of environmental protection and sustainable development, analyzing how international legal frameworks address disparities among states. By examining key principles such as common but differentiated responsibilities and respective capabilities, the study evaluates the effectiveness of existing mechanisms in promoting equitable participation and burden-sharing in global environmental governance. The research delves into the historical evolution of the principle of common but differentiated responsibilities, tracing its development from the Rio Declaration to the Paris Agreement. It highlights the tension between the need for collective action to address environmental challenges and the recognition of disparities in state capacities and responsibilities. By analyzing case studies such as climate change negotiations and biodiversity conservation efforts, the study assesses the practical implications of applying the principle of common but differentiated responsibilities in real-world contexts. Furthermore, the research investigates the concept of respective capabilities in international environmental law, exploring how states' varying capacities to address environmental issues impact their obligations and rights. By examining the role of technology transfer, financial assistance, and capacity-building initiatives, the study assesses the extent to which international legal frameworks promote the development and diffusion of environmentally sound technologies and practices. It also considers the challenges faced by developing countries in building their environmental governance capacities and the role of international cooperation in addressing these challenges. Through a critical analysis of relevant treaties, protocols, and court decisions, the research identifies gaps and inconsistencies in the application of equality principles in international environmental law. Project Overview

INTRODUCTION

To deal effectively with global environmental problems, such as climate change, we need global cooperation. Yet all too many developing countries lack the economics, infrastructures, and technical capacity to tackle these problems; therefore, developing countries need to be accorded differential treatment in the international environmental agreements adopted to prevent or mitigate the problems, if these agreements are to succeed.. This study addresses a very current, cutting-edge, and controversial issue of great importance to international environmental law and its success in protecting a livable planet.

In an attempt to get beyond words to action, this book looks at global environmental problems from the perspective of getting developing countries more involved in solving these problems. How can they best be brought into the realm of international environmental regulation and gotten o nto the pathway to sustainable development? The idea is that the new trend of using incentives to promote developing country participation in international environmental agreements – in effect, giving them differential treatment – must continue and become part of the framework of international environment
