Project Abstract

Environmental decision-making is a complex process that involves various stakeholders, including government agencies, businesses, non-governmental organizations, and the general public. The role of law in shaping these decisions is crucial, as it provides the framework within which environmental policies are formulated and implemented. This research project aims to explore the relationship between law and environmental decision-making, focusing on how legal principles influence the outcomes of such decisions. One key aspect of the role of law in environmental decision-making is the concept of legal compliance. Laws and regulations set the standards that businesses and other actors must adhere to in their environmental practices. Compliance with these laws is essential to ensure that environmental decision-making processes are carried out in a responsible and sustainable manner. Non-compliance can lead to legal sanctions and reputational damage, highlighting the importance of a strong legal framework in shaping environmental outcomes. In addition to legal compliance, the research project will also examine the role of legal instruments in promoting environmental goals. Laws can incentivize environmentally friendly practices through mechanisms such as tax incentives, subsidies, and market-based approaches like emissions trading. By analyzing the effectiveness of these legal instruments in driving positive environmental outcomes, the research aims to provide insights into how laws can be used as tools for achieving sustainability objectives. Furthermore, the research project will investigate the role of public participation in environmental decision-making processes. Public input is essential for ensuring that environmental policies reflect the values and priorities of the community. Legal frameworks that facilitate public engagement, such as requirements for public consultations and access to information, can enhance the legitimacy and effectiveness of environmental decisions. Overall, this research project seeks to contribute to a better understanding of the relationship between law and environmental decision-making. By examining the role of legal compliance, legal instruments, and public participation in shaping environmental outcomes, the research aims to provide insights that can inform the development of more effective and sustainable environmental policies. Ultimately, the goal is to highlight the importance of a strong legal framework in promoting responsible environmental decision-making and achieving long-term environmental sustainability.

Project Overview

INTRODUCTION

This collection draws together a range of approaches to environmental legal issues, covering a broad spectrum from domestic to international law. The contributors investigate aspects of law’s influence in environmental decision-making and consider whether legal institutions and theory can respond adequately to the challenge of environmental change.

`it is a book which provides an example of the way forward – a positive step in the right direction for environmental law … a book that is wide-ranging in its scope but which at the same time offers some valuable discussion of the significant key issues which are raised in these assorted jurisdictions and varied legal areas … this book provides a valuable contribution to the progress towards a more mature approach to enviromental law, as well as a collection that sign posts the way for other environmental lawyers.’ Fiona Donson, Law Quarterly Review, Oct 1999
