Project Abstract

Environmental decision-making is a complex process that involves various stakeholders, including government agencies, businesses, non-governmental organizations, and the general public. The role of law in shaping these decisions is crucial, as it provides the framework within which environmental policies are formulated and implemented. This research project aims to explore the relationship between law and environmental decision-making, focusing on how legal principles influence the outcomes of such decisions. One key aspect of the role of law in environmental decision-making is the concept of legal compliance. Laws and regulations set the standards that businesses and other actors must adhere to in their environmental practices. Compliance with these laws is essential to ensure that environmental decision-making processes are carried out in a responsible and sustainable manner. Non-compliance can lead to legal sanctions and reputational damage, highlighting the importance of a strong legal framework in shaping environmental outcomes. In addition to legal compliance, the research project will also examine the role of legal instruments in promoting environmental goals. Laws can incentivize environmentally friendly practices through mechanisms such as tax incentives, subsidies, and market-based approaches like emissions trading. By analyzing the effectiveness of these legal instruments in driving positive environmental outcomes, the research aims to provide insights into how laws can be used as tools for achieving sustainability objectives. INTRODUCTION

This collection draws together a range of approaches to environmental legal issues, covering a broad spectrum from domestic to international law. The contributors investigate aspects of law’s influence in environmental decision-making and consider whether legal institutions and theory can respond adequately to the challenge of environmental change.
